വിദേശ വരുമാനത്തിനു നികുതി തല്‍കാലമില്ല: ബാഗേജ്‌ ഇളവ്‌ 35,000 വരെ
ന്യൂയോര്‍ക്ക്‌: കേന്ദ്ര ധനമന്ത്രി പ്രണബ്‌ മുഖര്‍ജി അവതരിപ്പിച്ച ബജറ്റില്‍ ചെറുതെങ്കിലും ചില ആശ്വാസങ്ങള്‍ വിദേശ ഇന്ത്യക്കാര്‍ക്കുമുണ്ട്‌. ഒരു വര്‍ഷം ഇന്ത്യയില്‍ 60 ദിവസത്തില്‍ കൂടുതല്‍ തങ്ങുന്നവര്‍ വിദേശത്തെ വരുമാനത്തിനും ഇന്ത്യയില്‍ നികുതി നല്‍കണമെന്ന നിര്‍ദേശം തത്‌കാലം നടപ്പാക്കുന്നില്ലെന്നതാണ്‌ പ്രധാനം. ഏപ്രില്‍ ഒന്നു മുതല്‍ ഡയറക്‌ട്‌ ടാക്‌സ്‌ കോഡ്‌ എന്ന ഈ നിയമം നടപ്പിലാക്കുമെന്നാണ്‌ കരുതിയിരുന്നത്‌.

വിദേശ ഇന്ത്യക്കാരില്‍ നിന്ന്‌ കടുത്ത എതിര്‍പ്പാണ്‌ ഈ നിയമത്തിനെതിരേ ഉണ്ടായിരുന്നത്‌. ഒ.സി.ഐ കാര്‍ഡുള്ള വിദേശ പൗരന്മാര്‍ക്കുകൂടി ഇത്‌ ബാധകമായിരുന്നു. 4 വര്‍ഷത്തില്‍ 365 ദിവസത്തില്‍ കൂടുതല്‍ തങ്ങിയാലും ടാക്‌സ്‌ നല്‍കണം. ഗള്‍ഫിലും മറ്റുമുള്ള എന്‍.ആര്‍.ഐകളേയും, അമേരിക്കയിലും മറ്റുമുള്ള ഒ.സി.ഐ/പി.ഐ.ഒ കാര്‍ഡ്‌ ഹോള്‍ഡര്‍മാരേയുമൊക്കെ ബാധിക്കുന്നതാണ്‌ നിയമം.

നിയമം നടപ്പാക്കുമെന്ന്‌ മന്ത്രി പറഞ്ഞിട്ടുണ്ടെങ്കിലും എപ്പോള്‍ എന്ന്‌ വ്യക്തമാക്കിയിട്ടില്ല. അത്‌ നടപ്പിലാക്കാതിരിക്കാന്‍ വിദേശത്തുള്ളവര്‍ ഇനിയും ജാഗരൂകരായി പ്രവര്‍ത്തിക്കണമെന്ന്‌ ചുരുക്കം.

വിദേശ ഇന്ത്യക്കാര്‍ക്ക്‌ ബാഗേജ്‌ അലവന്‍സ്‌ 35,000 രൂപവരെ.
ഇപ്പോള്‍ 25,000 വരെ മാത്രം. പത്തുവയസുവരെയുള്ള കുട്ടികള്‍ക്ക്‌ ഇത്‌ 12,000 രൂപയില്‍ നിന്ന്‌ 15,000 രൂപയാക്കി.

സ്വര്‍ണ്ണത്തിന്റെ കസ്റ്റംസ്‌ ഡ്യൂട്ടി ഇരട്ടിയാക്കി. രണ്ടു ശതമാനത്തില്‍ നിന്ന്‌ നാലു ശതമാനം. ഇത്‌ സ്വര്‍ണ്ണം കള്ളക്കടത്തിന്‌ വഴിയൊരുക്കുമെന്ന്‌ ആശങ്ക ഉയര്‍ത്തിയിട്ടുണ്ട്‌.

ഒരു പവനിലേറെ സ്വര്‍ണ്ണം നാട്ടിലേക്കു കൊണ്ടുപോയ മലയാളികള്‍ എയര്‍പോര്‍ട്ടില്‍ പീഡനത്തിനിരയായ വാര്‍ത്തകള്‍ അടുത്തയിടയ്‌ക്ക്‌ `ഇ മലയാളി'യില്‍ തന്നെ പ്രസിദ്ധീകരിച്ചിരുന്നു. അത്‌ ഇനി കൂടുമെന്ന്‌ കരുതേണ്ടിയിരിക്കുന്നു. ഇതിനു പുറമെ നാട്ടില്‍ സ്വര്‍ണ്ണമായി നിക്ഷേപം നടത്തുന്നതും ആദായകരമാകും എന്നു വരില്ല. സ്വര്‍ണ്ണവില കൂടാനുമിടയുണ്ട്‌.

ആദായ നികുതിയിലുള്ള ഇളവ്‌ വിദേശത്തുള്ളവര്‍ക്കും കിട്ടും. രണ്ടു ലക്ഷം രൂപവരെ വരുമാനമുള്ളവര്‍ക്ക്‌ ടാക്‌സ്‌ വേണ്ട. 5 മുതല്‍ 10 ലക്ഷംവരെ വരുമാനമുള്ളവര്‍ 20 ശതമാനം ടാക്‌സ്‌ കൊടുക്കണം. 10 ലക്ഷത്തില്‍ കൂടുതല്‍ ഉള്ളവര്‍ക്ക്‌ 30 ശതമാനം ടാക്‌സ്‌ നിരക്ക്‌. പത്തുലക്ഷം രൂപ വരുമാനമുള്ളവര്‍ക്ക്‌ 22,000 രൂപയുടെ ഇളവ്‌ ലഭിക്കും.

വിദേശത്തുള്ളവര്‍ക്ക്‌ ഇന്ത്യയിലെ കോര്‍പ്പറേറ്റ്‌
ഡബ്റ്റ് (corporate debt) മാര്‍ക്കറ്റില്‍ നിക്ഷേപിക്കാന്‍ അവസരം നല്‍കി. കോര്‍പറേറ്റ്‌ ബോണ്ടുകളിലും മറ്റും നിക്ഷേപിക്കാന്‍ ഇനിമുതല്‍ പല കടമ്പകള്‍ കടക്കേണ്ടിവരില്ല.

എന്‍.ആര്‍.ഐകളുടെ 16 വര്‍ഷം മുമ്പു മുതലുള്ള ടാക്‌സ്‌ റിട്ടേണ്‍ പരിശോധിക്കാന്‍ ഇന്‍കംടാക്‌സ്‌ അധികൃതര്‍ക്ക്‌ അധികാരം നല്‍കിയിട്ടുണ്ട്‌. ഇത്‌ എന്‍.ആര്‍.ഐകളെ ദ്രോഹിക്കാന്‍ വഴിയൊരുക്കുമെന്ന്‌ ആശങ്കയുണ്ട്‌. ഏറെക്കാലം വിദേശത്തു കഴിഞ്ഞശേഷം നാട്ടില്‍ എത്തുന്നവര്‍ക്കാണ്‌ ഇത്‌ പ്രശ്‌നമാകുക.

ഇന്ത്യന്‍ കമ്പനികളിലും മറ്റും ഓഹരിയുള്ളവര്‍ക്ക്‌ ഇനിമുതല്‍ വിദേശത്തുനിന്ന്‌ ഇലക്‌ട്രോണിക്‌ വോട്ടിംഗ്‌ നടത്താമെന്നതാണ്‌ മറ്റൊരു മാറ്റം.

It would impact the Non-Residents in the following ways:

  • Marginal increase in existing tax slabs and basic tax exemption limit increased to Rs 2,00,000 (existing limit Rs 1,80,000).

Direct Tax Code delay spells relief for expatriates

Dubai India's federal budget did not have anything specific for non-resident Indians (NRIs). However, the deferring of the Direct Tax Code (DTC) is widely viewed as a relief.

Ahead of the budget, the biggest worry of NRIs centred around the DTC that was scheduled to take effect on April 1. The code proposes to change the basic definition of NRI for tax purposes. According to the new definition, NRIs present in India for more than 59 days in a financial year will be treated as residents.

Although the finance minister said yesterday that the government will work towards the implementation of DTC, he did not specify a timeframe or any amendments to the original DTC proposal against which a number of NRI representations were made.

"NRIs should be happy that the DTC bill restricting the stay of NRIs has not been introduced this year also," said Ram Buxani, a Dubai

Deferment of DTC till 2013 is welcome news for NRIs, but it should not come in its current form even next year," said Navin Kapoor, managing director of Xpertize United. Although NRIs did not receive any direct incentive in the budget, Gulf-based investors said the tax exemption for small investors will encourage NRIs to invest in Indian equity markets. "I appreciate the finance minister for supporting capital markets directly by introducing the Rajiv Gandhi Equity scheme and tax exemption for small investors," said K.V. Shams Al Deen, director of Barjeel Geojit Securities.

Import duty on gold up

Prominent NRIs welcomed the boost to the infrastructure sector but said the higher import duty on gold could result in increased smuggling.

"It's interesting to note that the FM has increased the import duty on gold from 2 per cent to 4 per cent. One cannot increase the import duty of gold beyond a certain percentage as it may result in smuggling," said James Mathew, managing director of Horwath Mak.

"The increase in the customs duty exemption on the baggage allowance from Rs25,000 (Dh1,786) to Rs35,000 is a welcome move," said Nagaraj N., manager, Abu Dhabi Commercial Bank. But the budget did not have anything else that benefited NRIs, he said

Measure: The government of India will now allow qualified foreign investors access to the Indian corporate debt market. Qualified foreign investors, or QFIs, can be individuals, groups or associations based abroad.

Impact: This proposal, when implemented will deepen the country's shallow bond market and also open up a lucrative avenue for foreign individual investors who are keen to participate in India's growth story. But, NRIs will hope for something more. On paper, NRIs were always permitted to invest in Indian corporate bonds. However, it required the issuing companies to enable the option for NRI investors with specific permission with the Reserve Bank of India. Often, companies chose not to do so, restricting access to NRIs. It is hoped that this move will also improve access for NRIs in the corporate bond market.

Measure: To introduce mandatory foreign asset reporting; income tax body to have powers to open previous returns of up to 16 years to check for tax evasion

Impact: While the intention of this proposal is to bring to book all those who have been evading taxes by stashing their money abroad, one fears that it will create unnecessary reporting requirements and needless harassment for NRIs who have returned to India after a long stint abroad.

Measure: Tax slabs have been changed to the following: Up to Rs 2 lakh: NIL (earlier Rs 1.8 lakh) Rs 2-5 lakh: 10% Rs 5-10 lakh: 20% (earlier Rs 5-8 lakh) Above Rs 10 lakh: 30% (earlier above 8 lakh)

Impact: For NRIs, as for all resident Indians, the tax liability will come down. A tax reduction of up to Rs 22,000 is likely on income of Rs 10 lakh.

Measure: The Direct Tax Code (DTC) which was expected to be implemented from April 2012, has been deferred for now

Impact: This might come as a relief for NRIs as some of the provisions of the DTC were quite harsh. For instance, under the proposed DTC, any individual (including NRIs/PIO) will become resident, if they are present in India for 60 days or more in the financial year and 365 days or more over a period of four years prior to the financial year and would be liable to pay taxes on their global income. This proposal would have impacted all those NRIs who visited India frequently for personal or business purposes.

Measure: To allow electronic voting for shareholders

Impact: If the Government allows electronic voting, this will help NRI shareholders to participate more actively

Measure: Gold purchases in India to become expensive; customs duty doubled

Impact: If keeping your money in India in the form of gold has been a favorite avenue, that might just change. Gold will become more expensive as the FM doubled customs duty.
